Judge Should Stay OT Action Or Change Venue: KPMG

Law360, New York (February 16, 2011, 2:35 PM EST) -- KPMG LLP has asked a federal judge to stay or transfer a suit alleging it denied overtime pay to a putative class of thousands of auditors, saying the claims are already subsumed by a consolidated action in California.

The plaintiffs are subject to the first-filed rule and have no sound argument as to why the case should be an exception, KPMG said in a motion filed Tuesday in the U.S. District Court for the Southern District of New York.
