KPMG Auditors' Overtime Action To Remain In NY

Law360, New York (March 22, 2011, 1:47 PM EDT) -- A New York federal judge on Monday rejected KPMG LLP's request to move to California a putative collective action accusing the accounting firm of giving audit associates short shrift on overtime pay.

Judge Colleen McMahon of the U.S. District Court for the Southern District of New York issued an order denying KPMG's Feb. 15 motion to transfer or stay the suit, which claims the company willfully misclassified audit associates and audit associate seconds as exempt employees.
