Calif. Appeals Court Rejects 49ers Stadium Challenge

Law360, New York (April 7, 2011, 3:00 PM EDT) -- A California appeals court ruled Wednesday that Santa Clara was not required to complete an environmental impact report when it approved a term sheet for a new San Francisco 49ers stadium near a Cedar Fair LP amusement park.

Santa Clara's decision to okay the term sheet, which bound it to continue negotiating with the 49ers in good faith, did not qualify as approval of the stadium project under the California Environmental Quality Act, the Court of Appeal of the State of California, Sixth Appellate District, ruled....
