Ky. Gets Purdue Oxycontin Case Sent To State Court

Law360, New York (September 26, 2011, 6:18 PM EDT) -- A New York federal judge on Monday remanded to state court Kentucky's suit alleging Purdue Pharma LP misrepresented the addictiveness of Oxycontin to consumers and defrauded Medicaid, dismissing Purdue's argument that the case was a class action under federal jurisdiction.

Kentucky Attorney General Jack Conway had asked the court, which is overseeing antitrust multidistrict litigation regarding the painkiller, to remand the case in 2009.
