Insurers Bank On Twombly To Get Suit Dismissed

Law360, New York (June 22, 2007, 12:00 AM EDT) -- Some of the country's largest insurance companies became the latest high-profile defendants to cite the U.S. Supreme Court's recent Twombly ruling on Thursday when they argued a court should dismiss a class action against them.

In a massive memorandum buttressing a motion to dismiss, the defendants in the multidistrict class action argued that the plaintiffs' third amended complaint, which alleges violations of federal antitrust and conspiracy laws, does not meet the heightened pleading standard required by the May 21 Supreme Court decision.
