Burger King Franchise Loses Beef With McDonald's

Law360 (June 25, 2007, 12:00 AM EDT) -- The U.S. Court of Appeals for the Eleventh Circuit has halted a Burger King franchise's quest to hold McDonald's Corp. accountable for the alleged competitive injury that resulted from the burger rival's purported false advertising of various promotional games.

On Monday, the Eleventh Circuit knocked down Phoenix of Broward Inc.'s appeal, upholding the U.S. District Court for the Northern District of Georgia's earlier ruling that the franchise lacked prudential standing to bring a false advertising claim against McDonald's under the Lanham Act.
