NBA's Antitrust Suit Against Players Thin, Judge Says

Law360, New York (November 2, 2011, 7:40 PM EDT) -- The allegations underpinning the National Basketball Association's preemptive antitrust case against its locked-out players' union are “frankly very thin,” the New York federal judge overseeing the case said Wednesday.

The suit, a declaratory judgment action that aims to head off a potential antitrust action from the players, has a complaint that takes a “kitchen sink” approach with broadly painted allegations, U.S. District Judge Paul G. Gardephe said in a hearing on whether the case should be dismissed.
