Judge: Too Soon To Judge YouTube 'Safe Harbor'

Law360, New York (June 28, 2007, 12:00 AM EDT) -- One of several copyright-infringement lawsuits against Google's YouTube Inc. moved a step closer to a trial last week after a judge ruled that neither side's claims justified pretrial judgment.

YouTube and the plaintiff, Robert Tur, an independent journalist whose videos have been displayed on YouTube's website, had both filed motions for summary judgment. YouTube's motion claimed that the online video server has achieved statutory “safe harbor” and thus only limited, injunctive liability; Tur's claimed that YouTube had failed to do so.
