Federal Law Bars BofA Debit Card Fee Suit: Judge

Law360, New York (November 28, 2011, 3:28 PM EST) -- A California federal judge last week tossed a proposed class action claiming Bank of America NA hid that contractually required monthly service fees for payroll debit cards were actually avoidable, ruling the National Bank Act blocked the suit's state law claims.

Tyrone Robinson filed the suit, dismissed Nov. 22, in April on behalf of California users of BofA's CashPay program, a voluntary program that allows individuals to directly deposit their paychecks onto debit cards.
