Railroad Reveals Subpoena Over Fuel Surcharges

Law360 (July 24, 2007, 12:00 AM EDT) -- Railroad company Burlington Northern Santa Fe Corp. on Tuesday disclosed that it has received a state grand jury subpoena requesting documents related to its practice of adding fuel surcharges to freight transportation services.

The disclosure was listed in the company's quarterly report, filed with the U.S. Securities and Exchange Commission. Texas-based BNSF, along with four other Class I railroads, have been named as defendants in 20 class-action complaints in six district courts around the country.
