Mexican Singer Joins Digital Royalty Fray With EMI Suit

Law360, New York (February 29, 2012, 3:22 PM EST) -- Latin pop singer Graciela Beltran on Tuesday hit EMI Music Inc. with a proposed breach of contract class action in California, joining a growing chorus of artists who claim record labels have stiffed artists on royalties for digital music downloads.

In a complaint filed in California federal court, Beltran claims EMI purposely miscalculated royalties owed to artists for digital downloads like MP3 files and ringtones by treating the downloads as sales of physical records rather than as licenses, which have a higher royalty rate.
