5th Circ. Denies BofA Late Claim In Dallas Logistics Case

Law360, New York (March 13, 2012, 7:40 PM EDT) -- The Fifth Circuit on Tuesday denied Bank of America NA's appeal of an order disallowing it from filing a late proof of claim in the Chapter 11 case of DLH Master Land Holding LLC, the developer of the Dallas Logistics Hub.

BofA's negligence, not that of its counsel, Snell & Wilmer LLP, was responsible for the late-filed claim, and the bank had plenty of opportunity to react to the bar date in the case and inform its lawyers in time to file a timely claim, the...
