Judge Throws Out AEP Suit Against BofA

Law360, New York (August 29, 2007, 12:00 AM EDT) -- AEP Energy Services Gas Holding Company's action against Bank of America NA over AEP's 2001 purchase of an energy company from Enron Corp. has been dismissed in its entirety, with a judge closing off the possibility of any further amendments to AEP's complaint.

Judge Thomas P. Griesa, of the U.S. District Court for the Southern District of New York, on Tuesday granted summary judgment to BofA and the other defendant, Bank of New York, which acted as trustee of a joint BofA-Enron special-purpose entity.
