Motorola, Apple Bids To Bar Damages Could Nix Patent Trial

Law360, New York (June 4, 2012, 7:20 PM EDT) -- Days ahead of their smartphone patent trial, a federal judge on Sunday ordered Motorola and Apple Inc. to explain whether the trial should proceed if he grants both parties' motions arguing their opponent is not entitled to damages or an injunction.

Apple and Motorola, each of which has accused the other of infringement, told U.S. Circuit Judge Richard Posner in separate summary judgment motions Friday that his May 22 order excluding some expert testimony by both parties effectively destroyed their opponent's damages arguments.
