9th Circ. May Send Time Warner OT Class To State Court

Law360, Los Angeles (July 11, 2012, 5:07 PM EDT) -- A Ninth Circuit panel on Wednesday suggested it might ask the California Supreme Court to decide an appeal claiming Time Warner Cable Inc. violated state overtime laws when it used sales agents’ future commissions to meet minimum wage requirements, saying California law doesn’t address the question.
