9th Circ. OKs $5M Verdict For Airline Crew In Hazard Pay Case

Law360, New York (July 19, 2012, 2:14 PM EDT) -- The Ninth Circuit on Wednesday upheld a $5.2 million class action verdict against government subcontractor Vision Airlines Inc. for stealing hazard pay from crew members who manned flights into war zones, and found that the class can pursue additional punitive damages against the company.

In addition to ruling that a Nevada district court appropriately sanctioned Vision for intentionally delaying production of documents and entered a default liability judgment, the appeals court said that the lower court erred in dismissing class claims for punitive damages and remanded...
