T-Mobile, HTC Say Consumer Is Stalling 4G False Ad Case

Law360, New York (July 26, 2012, 5:36 PM EDT) -- T-Mobile USA Inc. and HTC America Inc. asked a California federal judge Wednesday to dismiss a proposed class action, which alleges the companies lied about the capabilities of their 4G wireless phones and networks, because the plaintiff has not diligently pursued her claims.

The companies said plaintiff Stacy Arellano was ordered by the court more than 14 months ago to proceed with her case in individual arbitration, but has not yet done so.
