Filed Rate Doctrine Won't Bar Milk Mispricing Claims: 9th Circ.

Law360, New York (August 7, 2012, 8:18 PM EDT) -- Dairy farmers alleging misconduct against a buyers coalition that allegedly skewed prices by providing lowball rates to a milk pricing overseer may still pursue their case in spite of the filed rate doctrine's bar on such state law claims, the Ninth Circuit ruled on Tuesday.

The appellate court reversed a California federal court's ruling dismissing a quartet of dairy farmers' consolidated class action against the DairyAmerica Inc. collective, holding that the trial court was wrong to bar the suit under the pricing regulation.
