Appeals Court Lifts Stay In 9/11 Workers Case

Law360, New York (October 11, 2007, 12:00 AM EDT) -- An appeals court has vacated a stay in a case brought by workers who sued the City of New York over claims they suffered respiratory injuries at Ground Zero, ruling that the public interest favors permitting pretrial proceedings to resume.

In a decision handed down Oct. 5 but made public Wednesday, a three-judge panel of the U.S. Court of Appeals for the Second Circuit granted the plaintiffs’ bid to vacate the stay, which the court had imposed earlier to temporarily halt parallel proceedings in the U.S....
