Class Arbitration Barred If Not Noted In Contract: Calif. Court

Law360, San Diego (September 4, 2012, 10:32 PM EDT) -- A California appeals court on Friday sided with Liberman Broadcasting Inc. that a former security officer’s wage-and-hour class action has to proceed in arbitration on an individual basis, holding that an arbitration agreement silent on class actions can be inferred to bar class arbitration.
