Pittsburgh Penguins Ice TCPA Suit Over Fan Text Messages

Law360, Los Angeles (September 10, 2012, 9:09 PM EDT) -- A California federal judge Monday threw out a putative class action accusing the Pittsburgh Penguins of breaching contracts and violating the Telephone Consumer Protection Act by pummeling hockey fans with too many text messages.

U.S. District Judge Consuelo B. Marshall granted the Penguins' motion to dismiss the lawsuit, but said plaintiff Fred Weiss can amend his complaint and try again on allegations that the hockey club broke a pledge to send no more than three text messages per week to fans who signed up to receive...
