5th Circ. Affirms Class Cert. In Countrywide Loan Fee Suit

Law360, New York (September 17, 2012, 5:21 PM EDT) -- The Fifth Circuit on Friday denied Countrywide Home Loans Inc.'s bid to overturn the certification of a class of borrowers who claim they were charged illegal fees, ruling that the bankruptcy judge had properly defined the class.

The appeals court rejected the appeal by Countrywide, which had sought to overturn the bankruptcy court's July 2010 class certification order. The lender was sued in 2009 by a group of borrowers who claim that Countrywide threatened to foreclose on their homes if they did not pay additional fees...
