Biediger V. Quinnipiac: What Is A Sport Under Title IX?

Law360, New York (October 5, 2012, 2:27 PM EDT) -- Approximately two months ago, a federal appeals court ruled that competitive cheerleading does not meet the standards of a sport under Title IX and therefore cannot be counted when trying to comply with gender-equity requirements.[1] In Biediger, the Second U.S. Circuit Court of Appeals held Quinnipiac University discriminated against women when the school eliminated the women's volleyball team and replaced it with competitive cheering.[2] The court held competitive cheering did not meet the standards to be considered a sport under Title IX. Unfortunately, the decision, like the district court decision, did little to clarify the ambiguous definition of "sport" under the act....
