Jury Sides With Benihana In Managers' OT Pay Case

Law360, New York (October 22, 2012, 8:36 PM EDT) -- Benihana National Corp. on Monday prevailed in a class action brought by a group of restaurant managers who claimed Benihana misclassified them as exempt from overtime pay, after a California federal jury handed down a verdict for the restaurant chain.

The jury found that Benihana had properly classified plaintiffs Tetsuo Akaosugi, Hieu Nguyen and Rinko Donahue as exempt, bringing an end to the lawsuit against the chain. Additional class action claims had been settled earlier this year.
