Apple, Google Say Cert. Not Justified In Hiring Pact Suit

Law360, New York (November 15, 2012, 2:40 PM EST) -- Apple Inc., Google Inc. and five other technology companies said Monday that a proposed class action accusing them of fixing employee pay via "gentleman's agreements” doesn't show the alleged deals affected workers equally, asking a California federal judge to deny certification.

The tech giants said injuries suffered within the proposed class couldn't be calculated without determining which employees would have received higher paying and new positions in absence of the companies' alleged agreements to not compete for each other's employees, arguing that such individualized inquiries show...
