2nd Circ. Won't Reconsider Case Over NY Tribe's Casino

Law360, New York (November 28, 2012, 7:40 PM EST) -- The Second Circuit refused Wednesday to review its decision lifting a federal injunction against a 61,000-square-foot casino on tribal land in Southampton, N.Y., in a case raising jurisdictional questions over Indian land rights.

A majority of Second Circuit judges polled on whether to rehear the decision, which vacated a permanent injunction blocking the casino's construction, weren't in favor of reviewing the case en banc, according to an order.
