Brinker Doesn't Aid Verizon Wage Class, Calif. Court Says

Law360, New York (February 5, 2013, 4:20 PM EST) -- Verizon Wireless won't face class allegations that it failed to provide workers with meal breaks after a California state appeals court on Monday rejected the plaintiff's argument that the recent Brinker decision changed the law in his favor.

The California Court of Appeals affirmed a trial judge's previous ruling that denied class certification to Verizon sales rep Saul Deleon because his lawsuit over meal and rest breaks raised individualized questions of fact.
