DC Circ. Slams FCC's Tennis Channel Order Against Comcast

Law360, Washington (February 25, 2013, 2:13 PM EST) -- A D.C. Circuit panel on Monday blasted the Federal Communication Commission's attempt to force Comcast Cable Communications LLC to carry the Tennis Channel in the same package as its affiliated sports networks, saying the ruling creates significant First Amendment and regulatory conflicts.

The judges acknowledged during Monday's oral arguments that the FCC's arguments on Monday and previous decision could have broader implications for the entire media industry, forcing cable providers, newspapers or others to promote certain free speech over its counterparts, as Comcast asserted.
