Amazon, Apple End Dispute Over Survey After Expert’s Death

Law360, New York (March 6, 2013, 4:56 PM EST) -- Amazon.com Inc. and Apple Inc. on Monday resolved their tussle over how the online retailer can substitute a recently deceased expert who had conducted a survey on the "app store" mark in the iPad maker's trademark infringement and unfair competition suit.

In a filing in California federal court, Amazon pulled its February motion to substitute expert witness Ivan Ross, who passed away after a cancer diagnosis, and whose survey had found that that the “app store” mark is generic. Apple had not objected to Amazon’s bid...
