'Act Of War' Defense Frees American Airlines From 9/11 Suit

Law360, Chicago (March 20, 2013, 9:00 PM EDT) -- A New York federal judge on Wednesday dismissed a building owner's claims against American Airlines Inc. and others over property damage stemming from the 9/11 attacks, finding the Comprehensive Environmental Response, Compensation and Liability Act's "act of war" defense provided grounds for dismissal.

U.S. District Judge Alvin K. Hellerstein dismissed the defendants and found that the act of war defense — which has rarely been raised and has never been raised with success — did apply in Cedar & Washington Associates LLC's suit over cleanup costs...
