Military Contractor Fights Counselors' OT Class Bid

Law360, New York (April 8, 2013, 7:08 PM EDT) -- Military contractor Managed Health Network Inc. urged a federal judge on Friday to deny class status to counselors who claim the company shorted them on overtime pay, saying the case could be moot if it wins a bid to force the workers into arbitration.

Managed Health, which supplies counselors to military bases, said in a written brief that letting the plaintiffs proceed as a class would complicate the case and asked U.S. District Judge Susan Y. Illston to deny their request for conditional certification.
