9th Circ. Upholds Toss Of AT&T Text Spam Class Action

Law360, New York (April 18, 2013, 1:45 PM EDT) -- The Ninth Circuit on Wednesday affirmed the dismissal of a proposed class action accusing AT&T Mobility LLC of sending spam text messages, finding the company had a right to invoke the arbitration clause in the plaintiff’s wireless contract.

Suing on behalf of subscribers of now-defunct carrier Unicel Inc., plaintiff Alexandra Severance appealed a September ruling by U.S. District Judge Richard A. Jones compelling arbitration.
