2nd Circ. Won't Boot Judge From Publicis Sex Bias Case

Law360, New York (May 6, 2013, 7:40 PM EDT) -- The Second Circuit refused Thursday to disqualify a magistrate judge from overseeing the discovery process in a $100 million gender bias suit against French advertising company Publicis Groupe SA, denying a petition by the employees who filed the suit.

A three-judge panel found the workers — who contended that U.S. Magistrate Judge Andrew Peck was biased in favor of Publicis — had failed to prove the judge abused his discretion by denying their motion asking him to recuse himself in June.
