2nd Circ. Won't Disturb Prevailing Wage Law Precedent

Law360, Chicago (June 13, 2013, 5:59 PM EDT) -- The Second Circuit on Thursday declined to upend controlling precedent regarding prevailing wage claims against government contractors under the Davis-Bacon Act, rejecting a former Agfa Construction Inc. laborer’s attempt to revive a suit against the company.

In a brief opinion, a three-judge panel affirmed a lower court’s dismissal of plaintiff Jose E. Carrion’s prevailing wage claim, along with its decision denying him a new trial as to damages on a separate racial discrimination claim.
