Apple, Amazon End 'App Store' Trademark Fight

Law360, New York (July 9, 2013, 9:37 PM EDT) -- Apple Inc. and Inc. have agreed to end trademark infringement litigation over use of the phrase “app store” to market the companies' competing smartphone app retail stores, according to an order issued Tuesday in California.

U.S. District Judge Phyllis J. Hamilton signed off on an order dismissing the lawsuit in light of a covenant not to sue between Apple and Amazon that the companies entered into late last month. A trial over claims to the “app store” mark was scheduled to begin next month....
