Penske Dodges Class Cert. Of Dispatcher's Overtime Suit

Law360, New York (August 13, 2013, 6:03 PM EDT) -- A California federal judge on Friday declined to designate a suit alleging Penske Logistics LLC miscategorized dispatchers as supervisors in order to avoid paying them overtime as a class action, saying the manner in which some dispatchers did their jobs suggested they had not been misclassified.

Chief U.S. District Judge George H. King said the former employee who filed the suit accusing the company of improperly referring to its dispatchers as "operations supervisors" had not proven that all Penske's dispatchers didn't use independent judgment to fulfill...
