Racket Maker Ducks Claims Over Tennis Star Endorsements

Law360, New York (September 10, 2013, 4:02 PM EDT) -- A California judge on Monday stripped claims from a class action alleging racket maker Babolat VS North America Inc. deceives consumers through endorsements by tennis superstars Rafael Nadal and Andy Roddick, saying the plaintiff can sue only over racket types he actually bought.

U.S. District Court Judge Gary A. Feess determined that plaintiff Payam Ahdoot does not have standing to represent consumers who bought any of the company's pro-sponsored rackets other than the Nadal-endorsed AeroPro Drive he purchased, and he further dismissed unjust enrichment and restitution...
