Google Wi-Fi Snooping Not Protected, 9th Circ. Says

Law360, New York (September 10, 2013, 9:25 PM EDT) -- The Ninth Circuit on Tuesday rejected Google Inc.’s claim that the collection of data from unencrypted Wi-Fi networks by its Street View vehicles was permissible under a federal Wiretap Act exemption, allowing a consolidated California lawsuit to proceed.

A unanimous appeals panel determined that the data collected by the tech giant’s mapping cars could not be considered an electronic or radio communication that is readily accessible to the public, as required under an exemption in the act cited by Google.
