Federal Suit Bars NY Suit Over $2 Sirius Fee, Judge Says

Law360, Los Angeles (September 18, 2013, 4:23 PM EDT) -- A New York state judge on Wednesday dismissed a putative class action over a $2 administrative fee that Sirius XM Radio Inc. is accused of improperly charging some of its customers, finding it is barred by a now-dismissed federal lawsuit with the same claims.

The decision comes a month after the satellite radio company’s lawyers argued in a hearing in Manhattan that the federal case, which was mostly dismissed by U.S. District Judge Victor Marrero and affirmed last year by the Second Circuit, prevented the plaintiffs...
