Boeing Fund Investors Win Class Cert. In ERISA Suit

Law360, Los Angeles (September 19, 2013, 10:28 PM EDT) -- An Illinois federal judge granted class certification Thursday in an Employee Retirement Income Security Act suit alleging investors in a Boeing Co. retirement fund had been charged excessive and hidden fees, ruling plaintiffs had sufficiently limited the proposed class' size.

Holding the proposed class was no longer “breathtaking in its scope” or too broad, as the Seventh Circuit had previously found, U.S. District Judge David R. Herndon noted that it no longer included all past and future participants in the retirement plan.
