RadioShack Beats Former Store Manager's OT Action

Law360, Los Angeles (November 7, 2013, 7:25 PM EST) -- A New York federal judge on Thursday junked an ex-RadioShack Corp. store manager's putative class action accusing the company of miscalculating overtime pay for managers, ruling that RadioShack wasn't obligated to pay the workers time and a half.

U.S. District Judge Paul A. Engelmayer found that RadioShack's use of the fluctuating workweek method was permissible under federal rules even though the company had paid the managers performance-based bonuses instead of a fixed weekly rate.
