Ex-Applebee's Workers Tell 2nd Circ. Comcast Was Misapplied

Law360, New York (November 15, 2013, 7:54 PM EST) -- A trial judge misinterpreted the U.S. Supreme Court's Comcast decision when he denied class certification to restaurant workers in a wage-and-hour suit against an Applebee's franchisee because of the need for individual damages calculations, the workers told the Second Circuit Friday. 

Matthew Roach and other former Applebee's workers filed an opening brief urging the Second Circuit to reverse U.S. District Judge Thomas J. McAvoy's March 29 decision nixing their certification bid, a ruling which came on the heels of the high court's ballyhooed Comcast opinion. ...
