9th Circ. Won't Jump-Start Class Action Over Prius Defect

Law360, Los Angeles (November 21, 2013, 3:27 PM EST) -- The Ninth Circuit on Wednesday refused to revive a putative class action accusing Toyota Motor Corp. of not fixing its Prius vehicles, ruling a fuel-tank defect that caused inaccurate gas gauge readings in cold weather wasn't covered by Toyota's warranty.

Affirming a California federal judge's decision, the appeals court said named plaintiffs Henry and Veronica Troup hadn't proven they were injured by the flaw in their Prius, nor had they sufficiently repudiated Toyota's claim that it was an issue with the car's design.
