Twitter, Path Lend Muscle To Fight Against TCPA Vultures
Law360, New York (November 25, 2013, 8:59 PM EST) -- Twitter Inc. and Path Inc. last week jumped into a text-spamming class action against the Los Angeles Lakers in the Ninth Circuit, strengthening a long-running crusade to limit the expansive reach and opportunistic use of the Telephone Consumer Protection Act.
Characterizing the statute as “an extortionist club” being wielded by a plaintiffs' bar eager to capitalize on uncapped statutory damages of between $500 and $1,500 per violation, the social networking companies in a joint amicus brief filed Friday warned the appeals court that unchecked abuse of the TCPA risks stifling businesses' right to legitimate communications with consumers.
