In Blow to Knight Ridder, Judge Refuses to Dismiss Case

Law360 (January 6, 2006, 12:00 AM EST) -- Rejecting fair use as a defense, a California federal judge has denied a motion by Knight Ridder’s flagship paper, The San Jose Mercury News, to dismiss a copyright infringement action brought against it by a prominent Southern photographer.

U.S. District Court Judge Charles Breyer denied the Mercury News’ request for a summary judgment, propelling the case towards trial.
