Marriott Dodges Claims In Texas Resort Cost Overruns Suit

Law360, New York (December 4, 2013, 4:07 PM EST) -- A Texas appeals court on Tuesday tossed the bulk of real estate investment firm Miller Global Properties LLC's suit alleging Marriott International Inc. misled it into acquiring and covering $90 million in construction cost overruns on the JW Marriott San Antonio Hill Country Resort & Spa.

A three-judge panel of the Fifth District Court of Appeals in Dallas affirmed a lower court's decision granting partial summary judgment to Marriott on Miller's claims for fraudulent inducement, negligent misrepresentation and professional negligence.
