PersonalWeb Sanctioned For Erasing Emails In Google IP Row

Law360, Los Angeles (February 13, 2014, 10:29 PM EST) -- A California magistrate judge said Thursday that Google Inc. will be awarded yet-to-be-determined monetary sanctions in a suit accusing it and YouTube LLC of infringing patents for data processing systems, after Google sufficiently showed that plaintiff PersonalWeb Technologies LLC deleted emails relevant to the litigation.

Partially granting Google's motion for sanctions, U.S. Magistrate Judge Howard R. Lloyd found that PersonalWeb was under a duty to preserve evidence when it reasonably anticipated suing over its so-called "Truenames" patents, but that the company spoliated evidence as a result...
