2nd Circ. Warned Of 'Red Herring' In Applebee's Wage Suit

Law360, New York (February 18, 2014, 3:42 PM EST) -- The argument that a ruling refusing to certify a class of restaurant workers threatens to gut wage-and-hour class actions is a “red herring,” an Applebee's franchisee told the Second Circuit Friday, calling the class certification denial consistent with the U.S. Supreme Court's Dukes and Comcast rulings.
