Feds Back Truckers' Meal-Break Claims Before 9th Circ.

Law360, New York (February 19, 2014, 7:06 PM EST) -- Truck drivers looking to revive would-be class actions against Vitran Express Inc. and Penske Logistics LLC at the Ninth Circuit got a boost Tuesday when the federal government said the Federal Aviation Administration Authorization Act did not preempt California's meal- and rest-break requirements.

The United States filed nearly identical amicus briefs supporting workers' appeals that challenge the dismissal of the Vitran and Penske suits on the grounds that the FAAAA trumped the plaintiffs' state law claims. The U.S. has also asked to participate in oral arguments...
