Armstrong, Supplement Co. Cycle Past False Marketing Suit

Law360, New York (February 26, 2014, 1:15 PM EST) -- A California federal judge on Tuesday tossed a proposed class action accusing Lance Armstrong and sports supplement maker The FRS Co. of deceptively linking the cyclist's success to its products, finding the ads made claims no reasonable consumer would take at face value.

Lead plaintiff Robert Martin alleged FRS marketed its beverages, chews and powdered drink mixes as being Armstrong's “secret weapon” in his record seven Tour de France victories, when in fact he was using performance-enhancing drugs, which ultimately resulted his loss of the titles....
